Encino Child Support Basics

According to California law, all parents have the responsibility to financially support their children. This duty lasts until the child turns 18 and is graduated from high school, turns 19, marries, or joins the military.

Child support is a monthly payment that helps pay for a child’s living expenses. This helps ensure that the child receives the food, clothing, and medical care that he or she needs, as well as the opportunity for education.

Either parent or an individual who has legal or physical custody of a child may request a child support order from the court. This may be a request that is entered by itself, or as part of another family law matter, such as a divorce or a domestic violence case. If the parents are not married at the time of birth or conception, the mother will need to established paternity prior to requesting child support.

Determining the Amount of Child Support

In a case where one parent is requesting child support from the other, the two have the opportunity to agree on an amount. However, their agreement must be approved by a court official. To inform a judge of a parental agreement on child support, the parents must submit Form FL-350 with signatures from both parents. The Department of Child Support Services will also need to sign this form if they have been involved in your case.

When parents cannot agree on the amount to be paid, the parent requesting support may petition the court for a child support order. A judge will usually decide the amount of support to be paid based on the California child support guidelines. There are rare situations where a judge may determine an amount that is contrary to these guidelines.

Factors taken into consideration when calculating child support payments include:

  • The number of children the parents have together
  • The support given to children of other relationships
  • The amount of time each parent spends with the child
  • The income and earning capacity of each parent
  • The cost of health insurance
  • The expenses for education and daycare
  • The cost of uninsured health-care
