A Parent’s Request to Move

If you are a parent with sole physical custody of your child, you have the presumptive right to move away with your child. It is assumed that you are allowed to relocate with your child as long as you give proper and legal notice to the other parent of your intentions.

Should the other parent wish to prevent the move, the burden of proof is on him or her to prove that the move would be detrimental to the child.

Generally, when a parent has sole physical custody, a court will approve the move if:

  • The move is being made in good faith, not to hurt the other parent
  • The move will not negatively impact the rights and welfare of the child

When parents share custody or have joint physical custody, the situation is different. If the non-moving parent opposes the move, the parent who wishes to move with the child must demonstrate that the move would be in the best interest of the child.

At the move-away case hearing, the judge will consider evidence pertaining to:

  • The child’s age
  • The child’s relationship with both parents
  • The distance of the move
  • The relationship between the parents
  • The child’s preference for where to live
  • The purpose of the move
