Calculating Alimony in Encino

While California does have a method for calculating temporary alimony payments, there is no formula for long-term spousal support. Instead, the courts determine permanent alimony by considering several factors about the couple’s situation.

The factors considered when determining the amount of spousal support include:

  • The length of the marriage
  • The age and health of each party
  • The presence of any domestic violence
  • The needs of each party based on the lifestyle lived during the marriage
  • The income and earning capacity of both parties
  • The ability of the supporting party to pay alimony
  • The assets and debts received by both in a divorce settlement
  • The value of any separate property that either spouse may own
  • The impact on each individuals’ tax status
  • The hardships that each party experiences

The Duration of Spousal Support

Another issue of concern when determining spousal support is how long the payments will last. In general, couples that have been married for less than 10 years will have alimony payments that last for half the duration of the marriage.

For marriages that last longer than 10 years, the court does not put a limit on the duration of the payment. If at any point in the future the supporting party wishes to stop paying alimony, he or she will need to prove to the judge that other party no longer needs the support.
