The Types of Visitation Orders

One of the main components of a child custody case is the visitation order. Visitation orders are schedules that show when the child will spend time with each parent. If parents can agree on how they will share custody of the child, then they can create a parenting plan and submit it to the court for approval.

If the parents cannot agree, or the court denies the proposed parenting plan because it is unfair or not in the best interest of the child, a judge will decide how they will share custody.

There are four types of visitation orders that can be granted by a judge:

  • Reasonable visitation: Visitation arrangements are open-ended and left to the discretion of the parents
  • Visitation according to a schedule: Establishes the dates and times the child will spend with each parent, including which parent the child will be with on certain holidays
  • Supervised visitation: Visitation for one parent is limited to situations where he or she spends time with a child under the supervision of at least one other adult
  • No visitation: Visitation is prohibited for one parent because of the risk of physical or emotional harm to the child

Reasonable visitation orders are granted only to parents who have separated amicably. They demonstrate that they can still cooperate and maintain an open line of communication with one another. Visitation according to a schedule orders are common for parents who would have problems working together or wish to avoid future disagreements. Supervised and no visitation orders are only given if there is a concern for the child’s safety.
